Terms of Service

Welcome to Mochi! These Terms of Service (“Terms”) govern your use of the Mochi mobile app and website. By downloading or using Mochi, you agree to these Terms. If you don’t agree, please don’t use the service.

1) What is Mochi

Mochi is a photo cleanup app that helps you sort your camera roll with a simple flow (keep what you want, delete what you don’t).

2) Who can use Mochi

• You must be capable of entering into a binding agreement, or use Mochi under the supervision of a parent/guardian.
• Parents/guardians are responsible for anyone under 13 who uses the app under their supervision.
• You agree to comply with applicable laws and these Terms.

3) Permissions & your device

• Mochi may request access to your Photos library so you can review and manage your items.
• You control these permissions in iOS Settings and may enable, limit, or revoke access at any time.
• Actions that affect your library (for example deleting photos) are performed through Apple’s Photos framework on your device.

4) Your content & ownership

You own your photos and videos. Mochi does not claim ownership over your content. Any processing required for the app to function happens on your device as part of the core experience.

5) Acceptable use

To keep the service safe and reliable, you agree not to:

• Attempt to access data you don’t have permission to access or interfere with the service.
• Reverse engineer, scrape, or circumvent security or rate limits.
• Use the service for unlawful activities.

Intellectual property & restrictions

Mochi and all related materials (including the app, its design, UI, icons, text, code, and overall look & feel) are owned by LLAPPS LTD or licensed to us. These Terms grant you a limited, personal, non-exclusive, non-transferable, revocable license to use Mochi for your own lawful purposes.

You agree that you will not (and will not attempt to):

• Copy, reproduce, distribute, or publicly display any part of the app or website, except as allowed by law.
• Reverse engineer, decompile, disassemble, or otherwise derive source code, underlying ideas, algorithms, or structure.
• Create derivative works based on Mochi, or clone the app, its UI, or its workflows.
• Replicate behavior or “look & feel” in a way intended to substitute for Mochi or confuse users.
• Remove or obscure any proprietary notices, trademarks, or branding.
• Access the service by any automated means (scraping, bots) or bypass limitations or security controls.

These restrictions apply except to the extent prohibited by applicable law (for example, certain limited reverse engineering rights in some jurisdictions). If you believe you have a legal right to do any of the above, please contact us first at support@gallerysorter.app.

6) Privacy

Our Privacy Policy explains what data we collect and how we use it. By using Mochi, you also agree to the Privacy Policy.

7) Third-party services

Mochi may rely on third-party services for app operations, crash reporting, support, and essential website hosting or security. The website does not use analytics or tracking cookies. When providers are used, they process limited information under our instructions and contractual obligations. We are not responsible for third-party services and do not control their operations.

8) Changes to the Service and to these Terms

We may modify, suspend, or discontinue parts of the Service at any time, including adding or removing features. We may also update these Terms from time to time. The “Effective date” above indicates when these Terms were last updated.

If we make material changes, we will take reasonable steps to notify you (for example, on this website or within the app). Continued use of the Service after the effective date of the updated Terms means you agree to the updated Terms.

9) Fees

Some features of the Service may require payment (such as subscriptions or one-time purchases). If a paid feature is offered, the applicable price, billing terms, renewal terms (if any), and cancellation options will be presented to you at the time of purchase.

10) Service availability

We aim for a reliable service, but Mochi is provided on an “as is” and “as available” basis. We don’t guarantee uninterrupted or error-free operation. We may suspend or limit the service for maintenance, security, or legal reasons.

11) Disclaimer

To the maximum extent permitted by law, Mochi and LLAPPS LTD disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

12) Limitation of liability

To the maximum extent permitted by law, neither LLAPPS LTD nor its affiliates, directors, employees, or partners will be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, goodwill, or profits, arising from your use of the service. Our total liability for any claim will not exceed the amounts you paid to us (if any) in the 12 months before the event giving rise to the claim.

13) Indemnity

You agree to defend, indemnify, and hold harmless LLAPPS LTD from any claims, damages, or expenses arising out of your use of Mochi, or your violation of these Terms or applicable law.

14) Intellectual property

Mochi, including its name, logos, visual design, and code, is owned by LLAPPS LTD or licensed to us. These Terms don’t grant you any rights to our trademarks or intellectual property, except for the limited right to use the service as described here.

15) Termination

You may stop using Mochi at any time. If the app includes account-based features in the future, we will provide an in-app way to manage or delete an account (if applicable). We may suspend or terminate access if you violate these Terms, abuse the service, or if required by law.

16) Governing law & disputes

These Terms are governed by the laws of Bulgaria, without regard to conflict-of-laws principles. Courts in Varna, Bulgaria will have exclusive jurisdiction over disputes arising from these Terms or your use of the Service.

17) Apple platform terms

If you download the app from the Apple App Store, your use of the app is also subject to Apple’s applicable platform terms. To the extent these Terms conflict with mandatory platform terms, the platform terms will control. Apple is a third-party beneficiary of these Terms solely as related to your use of the app obtained through the App Store.
